DMCA Policy

Grand Magasin Atoll ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Grand Magasin Atoll website or online services (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice, how to submit a DMCA notice, and how to submit a counter-notice if your content has been removed due to a DMCA claim.

Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work. This could include the title of the work, the URL where it appears, or a registration number.
  2. Identification of the material that is claimed to be infringing: Identify the specific URL(s) or other specific location(s) on the Grand Magasin Atoll Site where the material that you claim is infringing is located. You must provide a reasonably sufficient amount of detail to allow us to find and identify the material.
  3. Contact Information of the Complaining Party: Your name, mailing address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the infringing material.

Counter-Notification

If you believe that material you posted on the Site was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our Designated Copyright Agent:

  • Identification of the material: Identify the material that was removed or to which access was disabled, and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Name, Address, and Telephone Number: Your full name, mailing address, and telephone number.
  • A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which Grand Magasin Atoll may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: A physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. If the original complainant does not file a court action seeking a court order to restrain you from engaging in infringing activity within 10-14 business days, we may restore the removed material.
